Can a spouse kick you out of the marital residence during an Ohio divorce?
Even if your spouse owns the marital residence and the mortgage is in their sole name, they cannot kick you out of the home unless there is a court order. We often have clients who have a spouse file for divorce against them and immediately demand that they leave the marital residence. You have the right to remain living in that home until a court order says otherwise. Dealing with an acrimonious divorce requires counsel from experienced divorce attorneys.
